1. Your responsibility
You must use QR Cigars lawfully and ensure that Brand Content, QR placement, subscriber activity, product claims, and linked sales channels comply in every location where they are available. An age gate, template, warning, review, or platform approval does not transfer that responsibility to QR Cigars.
2. Tobacco and age-restricted content
- Do not target, profile, encourage, or design tobacco promotion for minors or people below legal smoking age.
- Do not use QR Cigars to complete unlawful tobacco sales, distribute prohibited samples, evade age verification, or bypass packaging, tax, licensing, import, or advertising restrictions.
- Do not publish medical, therapeutic, safe-use, reduced-risk, cessation, pregnancy, or modified-risk claims without every authorization required by law.
- Use legally required health warnings and advertising restrictions for each destination. QR Cigars' general footer and age gate are not a substitute for a brand-specific legal review.
- Do not onboard or promote sanctioned, embargoed, illegally imported, or otherwise prohibited products or parties. Cuban-origin and other restricted products require specific legal review before use in affected markets.
3. Truthful content and rights
- Do not publish counterfeit, misleading, fraudulent, defamatory, or materially inaccurate content.
- Do not claim that a QR code proves more than the verification feature actually checks.
- Do not impersonate another brand or person or use trademarks, photos, stories, personal data, or other material without permission.
- Do not manipulate ratings, scans, subscriber counts, comments, or authenticity activity, including through bots, paid clicks, coordinated voting, or copied codes.
4. Privacy and communications
- Collect only information needed for a clear, lawful purpose and provide required notices at collection.
- Use subscriber exports only for the brand, channel, and purpose the person selected.
- Honor unsubscribe, withdrawal, deletion, objection, and opt-out requests without unnecessary delay.
- Do not sell, scrape, enrich, share, or combine QR Cigars subscriber data for unrelated targeting, data-broker activity, or another brand's marketing.
- Follow consent, double opt-in, sender identification, physical-address, quiet-hours, messaging-platform, and recordkeeping rules that apply to email, SMS, WhatsApp, and tobacco promotion.
5. Platform and security abuse
- Do not probe, scan, bypass, disable, overload, reverse engineer, or interfere with the Service or another account except under written authorization.
- Do not upload malware, harmful code, deceptive redirects, credential-harvesting pages, or content that creates a security or privacy risk.
- Do not use automated access, scraping, or bulk extraction except through an authorized API or written agreement.
- Do not evade plan limits, rate limits, suspension, authentication, or access controls.
- Do not use the Service for unlawful discrimination, harassment, threats, exploitation, or material that depicts or facilitates abuse.
6. Rights and safety reports
Send reports of infringement, counterfeit use, illegal promotion, privacy abuse, copied QR codes, or minor-safety concerns to hello@qrcigars.com. Include contact information, the exact URL or code, the protected work or issue, the basis for your report, and a good-faith statement that the information is accurate.
Knowingly false reports may create legal liability. We may ask for identity, authority, or supporting documents and may forward the report to the affected account holder when lawful.
7. Enforcement
We may investigate, preserve evidence, limit distribution, remove content, disable codes, suspend features, terminate accounts, notify affected parties, or contact authorities when reasonably necessary. We consider severity, recurrence, user harm, legal demands, cooperation, and corrective action. We are not required to monitor every page before publication.
Where appropriate, an account holder may appeal an enforcement decision by emailing hello@qrcigars.com with the decision, relevant facts, and requested outcome.
